Privacy policy, cookies and legal notice

This page informs you of our policies regarding the collection, use and disclosure of Personal Data we receive from users of TradeseC and our Customer Support System.

Furthermore, this page informs you of the usage of our website.

1. Introduction and important notice

In this Privacy Policy we make use of the followings definitions:

“GDPR” – The European General Data Protection Regulation

“Personal data” – any information relating to an identified or identifiable natural person (‘data subject’); an identifiable natural person is one who can be identified, directly or indirectly, in particular by reference to an identifier such as a name, an identification number, location data, an online identifier or to one or more factors specific to the physical, physiological, genetic, mental, economic, cultural or social identity of that natural person.

“Data controller” – the natural or legal person, public authority, agency or other body which, alone or jointly with others, determines the purposes and means of the processing of personal data; where the purposes and means of such processing are determined by Union or Member State law, the controller or the specific criteria for its nomination may be provided for by Union or Member State law.

“Processing” – any operation or set of operations, which is performed on personal data or on sets of personal data, whether or not by automated means, such as collection, recording, organization, structuring, storage, adaptation or alteration, retrieval, consultation, use, disclosure by transmission, dissemination or otherwise making available, alignment or combination, restriction, erasure or destruction

Who We are
We are TradeChannel AB (referred to herein as TradeChannel, “we” “us” or “our”).  We provide an integration and reporting solution through our platform TradeseC. At TradeChannel the privacy and security of our customers and visitors are of paramount importance. TradeChannel is committed to protecting the Personal data you share with us. This privacy policy explains how TradeChannel,  processes information that can be used to directly or indirectly identify an individual, i.e. Personal data collected through the use of our website, TradeseC and customer support system (the “Services”).  We will update this Privacy Policy from time to time in response to changing legal, regulatory or operation requirements. We will provide notice of any such changes (including when they will take effect) in accordance with law. Your continued use of our Services after any such updates will constitute your acceptance of these changes. If you do not accept any updates to this Privacy Policy, you may cancel your use of the Services.

For the purposes of this policy, TradeChannel defines the term “User” as an entity with which TradeChannel has an established relationship and the term “Visitor” as an individual that visits our front-end website (for example www.tradechannel.se).

Data protection principles:
All processing of Personal data by TradeChannel is conducted in accordance with the data protection principles as set out in data protection laws and regulations in Sweden, in particular Article 5 of GDPR.
These principles are:
Lawfulness: We only process your Personal data when we have identified a lawful basis for the intended Processing pursuant to Article 6 of the GDPR. These are often referred to as the “conditions for processing”.

Fairness: We have made reasonable effort to ensure not to use your Personal data in any unjustified way or in a manner which may have adverse effects on our users, as well as kept to minimum in order to provide users with qualitative products and services.

Transparency: We have made our best efforts to provide you detailed information on TradeChannels use of your Personal data. Our Users and Visitors are encouraged to contact us whenever they have questions or seek information about our privacy procedures.

Any information stored on TradeseC is treated as confidential. All information is stored securely and is accessed by authorized personnel only. TradeChannel implements and maintains appropriate technical, security and organisational measures to protect Personal data against unauthorized or unlawful processing and use, and against accidental loss, destruction, damage, theft or disclosure.

2. Collection and use

2.1 .General

The following sections cover the specifics of each of the three groups from which data is collected: website Visitors, TradeseC Users and registered Users in our customer support system.

2.2 Website Visitors

If you are a Visitor to our website only, and not a user of TradeseC or registered  in our customer support system, then this section is relevant for you.

By visiting this website, you consent to the collection and use of your Personal data as described herein. If you do not agree with the terms set out herein, please do not visit this website. If required by applicable law, we will seek your explicit consent to process Personal data collected on this website or volunteered by you. Kindly note that any consent will be entirely voluntary. However, if you do not grant the requested consent to the processing of your Personal data, the use of this website may not be possible.

TradeChannel may collect, record and analyze information of Visitors to our website. We may record your IP address and use cookies. TradeChannel may add information collected by way of page view activity. Furthermore, TradeChannel may collect and process any Personal data that you volunteer to us in our website’s forms, such as when you register for events or sign up for information and newsletters.

Such Personal data may comprise your IP address, first and last name, your postal and email address, your telephone number, your job title, data for social networks, your areas of interest, interest in TradeChannel products, and certain information about the company you are working for (company name and address), as well as information as to the type of relationship that exists between TradeChannel and yourself.

TradeChannel gathers data about visits to the website, including numbers of Visitors and visits, Geo-location data, length of time spent on the site, pages clicked on or where Visitors have come from.

2.2.1 Purpose of processing personal data

TradeChannel uses the Personal data and information collected  to communicate with Visitors, to customize content for Visitors, to show ads on other websites to Visitors, and to improve its website by analyzing how Visitors navigate its website.

2.2.2 Sharing personal data

TradeChannel may also share such information with service vendors or contractors in order to provide a requested service or transaction or in order to analyze the Visitor behavior on its website.

2.2.3 Cookies

Cookies are files with small amount of data, which may include an anonymous unique identifier. Cookies are sent to your browser from a web site and stored on your computer’s hard drive. Like many websites, we use “cookies” to collect information. You can instruct your browser to refuse all cookies or to indicate when a cookie is being sent. However, if you do not accept cookies, you may not be able to use some portions of our Website. We may also place cookies from third parties for functional and marketing purposes. The use of cookies is widespread and benefits the Visitor. 2.2.4 Links to other sites

Please be aware that while visiting our site, Visitors can follow links to other sites that are beyond our sphere of influence. TradeChannel is not responsible for the content or privacy policy of these other sites.

2.2.5 Usage of marketing collateral

All material on TradeChannel’s website is provided “AS IS” without any implied or expressed warranties of any kind including non-infringement of intellectual property.

2.3 Users of TradeseC and Users registered in our Customer Support System

2.3.1. General

In order to provide services to its Users of TradeseC and Users registered in our Customer Support System, TradeChannel receives  and processes certain types of Personal data.  However, TradeChannel is then acting as a service provider only processing Personal data on behalf of its customer/s.  To the extent that we are acting as a User’s Data processor, we will process Personal Data in accordance with the terms of our agreement with the User and the User’s lawful instructions.

2.3.2 Processing  User data in TradeseC

Clients to TradeChannel administrate who have access to TradeseC. Personal data TradeChannel, in its role as Data processor, receives from users of TradeseC is only used for identifying you as user for the application and we are then acting in accordance with the terms of our agreement with the User and the User’s lawful instructions.

2.3.3 Collection of User data in our Customer Support System

Personal Data TradeChannel, in its role as Data Processor, receive from users of our Customer Support System is only used for identifying you as user for the application.

Data entered or transferred into TradeChannel by Users such as texts, questions, contacts, media files, etc., remains the property of the User and may not be shared with a third party by TradeChannel without express consent from the User.

The Customer Support System TradeChannel make use of uses Microsoft Corporation as a cloud computer service provider (“Microsoft Azure Service”). Microsoft Azure Services are provided under the Online Services Terms (OST) available at the following link https://www.microsoft.com/en-us/Licensing/product-licensing/products.aspx. Personal Data is stored within EEA.

Clients to TradeChannel administrate who have access to our Customer Support System and we are only processing Personal Data in accordance with the terms of our agreement with the User and User’s lawful instructions.

2.3.3 TradeChannel as a Processor and Controller

TradeChannel act both as Data controller and Processor, as described in GDPR. This Privacy Policy only covers our responsibility as a Data controller of Personal Data. Our responsibility as a Processer is governed by Data Processing Agreement we have with our clients in their capacity as Data controllers. Thus, to the extent that we are acting as a User’s data processor, we will process Personal Data in accordance with the terms of our agreement with the User and the User’s lawful instructions.

3. Retention and deletion

TradeChannel will not retain data longer than is necessary to fulfill the purposes for which it was collected and to provide our Services or as required by applicable laws or regulations. When a TradeseC user’s account is terminated, all Personal data collected through the platform will be deleted, as required by applicable law.

4. How to exercise your rights

TradeChannel takes steps to keep your Personal Data accurate and up to date. You have certain rights to the Personal Data that we have collected about you. To exercise your rights to your Personal Data, please contact us by using the TradeChannel Privacy Contact (see § 7).

You have the following rights:

Right of access to your Personal Data (Art. 15 GDPR): You have the right to ask us for confirmation on whether we are processing your Personal data, and access to the Personal data and related information on that processing (e.g., the purposes of the processing, or the categories of Personal data involved).

Right to correction (Art. 16 GDPR): You have the right to have your Personal data corrected, as permitted by law.

Right to erasure (Art. 17 GDPR): You have the right to ask us to delete your Personal data, as permitted by law. This right may be exercised among other things: (i) when your Personal data is no longer necessary for the purposes for which it was collected or otherwise processed; (ii) when you withdraw consent on which processing is based according to Art. 6(1)(a) or Art. 9 (2)(a) GDPR and where there is no other legal ground for processing; (iii) when you object to processing pursuant to Art. 21 (1) GDPR and there are no overriding legitimate grounds for processing, or when you object to the processing pursuant to Art. 21 (2) GDPR; or (iv) when your Personal Data has been unlawfully processed.

Right to restriction of processing (Art. 18 GDPR): You have the right to request the limiting of our processing under limited circumstances, including; when the accuracy of your Personal data is contested; when the processing is unlawful and you oppose the erasure of your Personal data and request the restriction of the use of your Personal data instead; or when you have objected to processing pursuant to Art. 21 (1) GDPR pending the verification whether the legitimate grounds of TradeChannel override your grounds.

Right to data portability (Art. 20 GDPR): You have the right to receive the Personal data that you have provided to us, in a structured, commonly used and machine-readable format, and you have the right to transmit that information to another controller, including to have it transmitted directly, where technically feasible.

Right to object (Art. 21 GDPR): You have the right to object to our processing of your Personal data, as permitted by law. This right is limited to processing based on Art. 6(1) (e) or (f) GDPR, and includes profiling based on those provisions, and processing for direct marketing purposes. After which, we will no longer process your Personal data unless we can demonstrate compelling legitimate grounds for the processing that override your interests, rights and freedoms of for the establishment, exercise or defense of legal claims.

5. Acceptance of these Conditions

We assume that all Visitors of our website and Users of TradeseC and our Customer Support System have carefully read this document and agree to its contents. If someone does not agree with this privacy policy, they should refrain from using our website, TradeseC and Customer Support System, i.e. the Services. We reserve the right to change our privacy policy as necessity dictates. Continued use of TradeChannel’s website, TradeseC and our Customer Support System, i.e. the Services,  after having been informed of any such changes to these conditions implies acceptance of the revised privacy policy.

6. Our Legal Obligation to Disclose Personal Information

We may disclose your Personal data with law enforcement, government or regulatory bodies, lawful authorities, or other authorized third parties in order to comply with laws, regulations, court orders, or other legal obligations or to assist in an investigation, to protect and defend our rights and property, or the rights or safety of third parties, to enforce this privacy policy or agreements with third parties, or for crime-prevention purposes.  We are permitted to disclose personal information when we have good reason to believe that this is legally required.

7. Limitations of liability

In no event will TradeChannel AB be responsible for any damage (including but not limited to loss of data, loss of profit, interruption of business, satisfactory quality, merchantability and fitness for a particular purpose), due to use of this website or any information on this website
